This Privacy Notice for Individuals in a Business or Commercial Relationship with Ford (“B2B Notice”) describes how Ford Motor Company, its affiliates, divisions and brands (e.g., Lincoln) (“Ford,” “our,” “we,” or “us”) collect, use, and disclose Personal Information of individuals who interact with Ford as an employee, owner, director, officer, or independent contractor (“B2B Personnel”, “you”, or “your”) of another company, partnership, sole proprietorship, non-profit, or government agency (collectively, “Entity”), including when you access a Ford website or online platform using Ford credentials and offline locations where this B2B Notice is made available to B2B Personnel (collectively, the “B2B Services”).

B2B Personnel Personal Information We Collect

 

Personal Information” means any information related to an identified or identifiable natural person, subject to applicable data protection laws. Personal Information includes the term “personal data” as used in data privacy laws.
 

Depending on the nature of your interaction with us and based on specific legal limitations in your region (see Region-specific Legal Disclosures, we may collect the following types of Personal Information about you, some of which may be considered sensitive Personal Information under applicable law. Note that the specific Personal Information we collect about you may not include all the examples listed.
 

  • Contact information, including name, postal address, unique personal identifier, online identifier, IP address, email address, fax number, phone number, account name, or other similar identifiers.
  • Tax information, including social security number in the United States, Social Insurance Number in Canada, and national identification number or its equivalent in other regions.
  • Demographic information (as permitted in your country of residence), including age, gender, race, nationality, disability, and military or veteran status.
  • Commercial information, including records of products or services purchased, obtained, considered, or used (on behalf of your Entity), or information related to incentive programs.
  • Internet or other electronic network activity information, including browsing history, search history, and information regarding your interactions with our B2B Services.
  • Location data, including time zone and geolocation, such as location data inferred from your device IP address.
  • Audio, electronic, visual, or similar information, including photographs, videos, and audio recordings as may relate to your job functions, education, training, marketing, enablement, and security.
  • Account details, including account names, passwords, and security questions.
  • Content of communications, including emails, customer service requests, website chats, and survey responses.
  • Professional and employment-related information, including affiliated Entity, job title, work experience, and other information regarding your employment or included in a resume or CV.
  • Education and enablement information, including educational information, qualifications, certifications, skills, training, ranking, education, enablement, coaching, and other information regarding your qualifications and participation in Ford enablement programming, including Ford University.
  • Inferences used to create a profile reflecting your preferences, characteristics, abilities, and aptitudes.
     

We may engage vendors, such as LivePerson or Google Vertex, to provide certain interactive features on our B2B Services. Your use of these interactive features is voluntary, and we may retain the information that you submit through these features. For example, we may offer an interactive chat feature for customer service, transactional, and other informational purposes. When you participate in interactive chat, either with a virtual or live agent, the contents of the chat may be captured and kept as a transcript. By using these features, you understand that our vendors may process the information you submit to provide the service on our behalf. By using an interactive chat feature, you may be interacting with a Generative AI platform and not a live person. Unless otherwise provided for as part of the B2B Services, do not provide confidential or proprietary information when using an interactive chat feature. Information, decisions, or advice provided by an interactive chat feature, or any materials retrieved therefrom, including those to any third party, may not have been reviewed for content or accuracy. Some technologies used on our websites and platforms allow us and our service providers to monitor and analyze how visitors use our websites and platforms to better understand user behavior and improve the B2B Services. When you interact with us online, information related to your behavior may be collected by us and our service providers.
 

In accordance with applicable laws, we may use artificial intelligence, algorithms, automated decision-making technology, and other automated means to process your Personal Information in tools that we make available to you in connection with the duties and obligations you perform on behalf of your Entity. You may have certain rights related to such automated processing, which may vary depending on your location.

 

 

How We Use B2B Personnel Personal Information

 

In accordance with applicable law, we may use B2B Personnel Personal Information for the following purposes:
 

  • Conduct Business. We may use your Personal Information to conduct business with your Entity, such as processing transactions and orders for your Entity, provide customer support; and generate website analytics to improve our platforms and systems.
  • Operate, Maintain, and Improve our B2B Services. We may use your Personal Information to understand how you use our B2B Services; customize or personalize your experience; monitor and analyze trends, usage, and activities of B2B Service users; compile user data, including with data about users that we collect through other sources and may be used for marketing and other purposes where legally permitted; deliver promotional content; improve our B2B Services; develop new products, services, and marketing; provide technical support and troubleshoot; offer customer assistance; and safeguard our B2B Services.
  • Training and Enablement. We may use your Personal Information to provide you with education, training, enablement, coaching, and practice opportunities, including practice modules with automated scoring used to assist you in improving your skills.
  • Communication. We may use your Personal Information to communicate with you, such as by providing you information on new training, education, and enablement opportunities, incentive programs, or products and services that may benefit you or your Entity. We may also use your Personal Information to communicate with you when you contact us for help or engage with our chat functionality.
  • Access Management. We may use your Personal Information to manage your access rights to the B2B Services and the physical location of our premises, such as by providing you with login credentials to the B2B Services, badges to enter buildings, and otherwise manage our physical and corporate information technology and system security.
  • Legal Obligations and Security. We may process your Personal Information to fulfill our legal obligations, including reporting and tax documentation; prevent, investigate, identify, or take any other action regarding suspected or actual fraudulent or illegal activity, or any activity that violates or may violate applicable laws, regulations, legal processes, or our policies. We may use, screen, and share your Personal Information as part of our due diligence procedures; to assist in verifying your identity; to facilitate and manage our relationship with you; to protect our or others’ interests; and to comply with Office of Foreign Asset Control or other prohibited or denied party lists and international governmental or regulatory requirements concerning, among other things, money laundering, asset control, and anti-terrorism. Ford will not make any solely automated decisions which significantly affect you. As a result of our watchlist screening process, we may from time to time request additional or specific identification or documents from you regarding you or your business. We may process your Personal Information to comply with applicable laws, regulations, or legal processes as well as industry standards and our company policies. Additionally, we may process your Personal Information to meet our contractual and legal obligations and protect the security of our systems and personnel.
  • Diversity, Equity, and Inclusion. We may use your Personal Information to understand the diversity of your Entity and manage related programs or initiatives.
  • Develop Training and Enablement Materials. We may use your Personal Information to offer, develop, or provide training, enablement, and education products or services, including based on aggregated usage and your location.
  • Travel Reimbursement. We may use your Personal Information to maintain records in the management of our operations and business, which may include arranging travel, reimbursing B2B Personnel’s expenses, issuing tax documents, or paying incentive awards.
  • Onboarding. We may use your Personal Information to onboard and enroll you as B2B Personnel of your Entity with whom we conduct business.
  • Corporate Restructuring. We may use your Personal Information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us is among the assets transferred.
  • Consent. We may use your Personal Information for other purposes that you consent to.

 

 

How We Collect B2B Personnel Personal Information

 

In accordance with applicable law, we may collect B2B Personnel Personal Information identified above from the following sources (whether we collected information from a specific source depends on the nature of your interaction with us):
 

  • Directly from you or your agent. We may collect Personal Information from you when you provide it to us, such as in connection with a purchase order or a training, enablement, education, or session; while interacting with our B2B Services; when you contact us; or when you provide information in response to a survey.
  • Created by us. We create Personal Information about you, such as credentials for access to our information technology systems or inferences generated to provide you with training, education, enablement, coaching, and practice opportunities, including practice modules with automated scoring used to assist you in improving your skills.
  • Parties acting on our behalf. We collect Personal Information about you from certain agents, vendors, consultants, affiliates, and service providers that provide information to help us manage or operate our business.
  • Third Parties. We may obtain Personal Information from third parties, some of whom may sell the information to us, to help us provide goods and services, update and improve our records, create more personalized advertising, and suggest services that may be of interest.
  • Affiliates and Family Companies. We collect Personal Information from companies within the Ford Motor Company family of companies and affiliates. We receive information within this “family,” as permitted, to help us manage our business and workforce.
  • Law enforcement agencies, courts, regulatory agencies, and other government agencies. We may receive information from government agencies to comply with the law, to protect your personal safety or the safety of others, to protect our or others’ rights, or to investigate fraudulent or illegal activity, or any activity that violates or may violate applicable laws, regulations, legal processes, or our policies.
  • Your Entity. We may receive information about you from your Entity to help us manage or operate our business.
  • Parties to corporate transactions. As permitted by law, we may receive Personal Information as part of a corporate transaction or proceeding such as a merger, financing, acquisition, bankruptcy, dissolution, or at transfer, divestiture, or sale of all or a portion of a business or assets.
  • Public sources. We may also collect information available on public company registers about you or other public sources associated with your business.
  • Automatically when using the B2B Services. We automatically collect certain information about you when you use our information technology services and when you access our facilities, including video surveillance information.
     

We may combine Personal Information we obtain about you from one source with Personal Information we obtain through other means described above.

 

 

How We Use Cookies and Tracking Technologies

 

Our B2B Services use cookies, pixels, web beacons, tags, trackers, and similar digital technologies (“Tracking Technologies”) to operate our B2B Services and to help collect data. Cookies are small text files placed on your device to store data that can be recalled by a web server in the same domain that placed the cookie. The text in a cookie often consists of a string of numbers and letters that uniquely identifies your device, but it can contain other information as well. Our B2B Services may also contain electronic images known as web beacons (also called single-pixel gifs) that we use to help deliver cookies on our B2B Services, count users who have visited those B2B Services, and gather usage and performance data.
 

Tracking Technologies on B2B Services are used to store your preferences and settings, help authenticate your Ford account and enable you to sign in, combat fraud, analyze how our B2B Services perform, personalize your experience and the content you see on our B2B Services (such as by conveniently auto-filling data fields in online forms), and fulfill other legitimate purposes.
 

We also include Tracking Technologies in our promotional email messages or newsletters to perform analytics, including to determine whether you open and act on them, and in our ads appearing on Other Sites to measure the performance of those ads.
 

Our B2B Services often include Tracking Technologies from third-party vendors. In some cases, that is because we have hired the third party to provide services on our behalf, such as site analytics. In other cases, it is because our webpages contain third-party content (such as embedded videos, maps, plug-ins, or ads) that contain digital technologies used to track operability and performance of the content, as well as your interaction with the content to determine its effectiveness. When your browser connects to a third party’s web server to retrieve content and/or Tracking Technologies, that third party is able to set or read its own Tracking Technologies on your device and may collect information about your online activities over time and across different websites or online services that also contain that third party’s content or Tracking Technologies.
 

For example, our B2B Services use third-party tools (such as Mouseflow, Dynatrace, and Google services), to support the operation and performance of our B2B Services and to analyze your interactions and experiences with our B2B Services, including the features you engage with, how you navigate, and your click/touch, movement, scroll, and keystroke activity.

Disclosures of B2B Personnel Personal Information

 

We disclose B2B Personnel Personal Information with your consent, when you direct us to share it with others, in order to conduct business with your Entity, and otherwise to operate our business. We may disclose your Personal Information for the purposes above to the following entities and individuals:
 

  • Our Affiliates and family companies. We disclose your Personal Information to our affiliates and family of companies for business and operational purposes.
  • Your Entity. We disclose your Personal Information with your Entity and Entity personnel for your Entity to sign you up to use the B2B Services, where instructed by you, when necessary to fulfill the service or provide the good you request, and for other business and operational purposes (e.g., to ensure your training and enablement credentials are current and complete). Your Entity may use such Personal Information in accordance with their own privacy policies.
  • Dealers. We may disclose Personal Information to authorized dealers where necessary, including honoring requests related to the B2B Services and providing information about B2B Personnel training, enablement, and education. Each dealership operation is a separate legal entity, independent from Ford. As such, each dealership has its own privacy practices and Ford is not responsible for these privacy practices.
  • Parties involved in training and enablement. We may disclose your Personal Information to parties involved in training and enablement programs, including faculty, administrators, coaches, and other participants, including to demonstrate training skills, show rankings, and determine progress.
  • Agents, vendors, consultants, and service providers. We disclose your Personal Information to agents, vendors, consultants, and service providers that help us provide the B2B Services to you and operate our business.
  • Law enforcement agencies, courts, regulatory agencies, and other government agencies. We may disclose your Personal Information to comply with reporting obligations (such as taxing authorities), legal processes (such as court orders, subpoenas) or other legal requirements of any governmental authority, whether in connection with threatened or actual litigation or otherwise, to protect our legal rights or property, to enforce our policies and procedures, to protect the legal rights or property or physical security of others, or for the prevention or detection of crime where such disclosure is lawful.
  • Insurers and professional advisers. We may disclose your Personal Information to manage risks, obtain professional advice, perform investigations, and exercise or defend against legal claims.
  • Third Parties. We may disclose Personal Information to third parties where instructed by you; as necessary to fulfill the service or provide the good you request; or to prevent, detect, investigate, identify, or take any other action regarding suspected or actual fraudulent or illegal activity, or any activity that violates or may violate applicable laws, regulations, legal processes, or our policies.
  • Parties to corporate transactions. As permitted by law, we may disclose your Personal Information as part of a corporate transaction or proceeding such as a merger, financing, acquisition, bankruptcy, dissolution, or at transfer, divestiture, or sale of all or a portion of a business or assets.

 

 

Choice and Control of B2B Personnel Personal Information

 

You may receive access to websites and applications owned or managed by us where you have a profile you can access. For these applications, you may have the ability to modify your own Personal Information in your profile.

Cookies and Tracking Technologies

 

Cookies may generally be disabled or removed by tools available as part of most commercial browsers, and in some instances blocked in the future by selecting certain settings. Browsers offer different functionalities and options, so a user may need to set them separately. Users should review their browser’s help menu for instructions, or visit www.allaboutcookies.org for more information. Please note that if all cookies are disabled, some features of the B2B Services may not function properly.
 

Certain B2B Services include additional mechanisms for managing cookie and tracking technology preferences. Please refer to individual B2B Services for additional information.
 

Browser settings may allow users to automatically transmit a “Do Not Track” signal to online services visited. Note, however, there is no consensus among industry participants as to what “Do Not Track” means in this context. Like many websites and online services, the B2B Service may not be designed to respond to “Do Not Track” signals received from browsers. Instead, you can use the range of other tools to control data collection and use, including the cookie controls and advertising controls described below.

 

Email Communications

 

A user may unsubscribe from our marketing email communications by clicking the “unsubscribe” link found in every marketing email we send. If a user opts-out of our marketing email communications, we may still send email messages related to the user’s account or the B2B Services. Unsubscribing from our marketing communications will not affect the level or quality of service we provide.

 

 

Other Sites and Services

 

Our B2B Services may contain links to other content, products, services, features, websites, mobile applications, platforms, or properties that Ford does not own or operate (“Other Sites”) even if they look similar to ours. Please be aware that Ford is not responsible for any Other Sites, their content or operation, or the privacy policies or data practices of the parties that offer the Other Sites, even if you access them via our products or services.
 

Some of our B2B Services incorporate the Google reCAPTCHA tool, which collects hardware and software information, such as device and application data, in order to perform integrity checks and help prevent bots from using the feature. Your use of the reCAPTCHA tool is subject to the Google Privacy Policy and Terms of Use.
 

Ford is also not responsible for third party applications or services that are governed by a privacy policy other than Ford’s and that may:
 

  • Be integrated with or offered through our B2B Services; or
  • Require or permit by the account you have with the third party to be linked to B2B Services.
     

Some of our B2B Services include mapping features provided by Google, HERE, and Microsoft (Bing Maps), which will collect and use Personal Information, including location information. If you use those mapping services, provide Personal Information to any of those third parties, or consent to our disclosure of Personal Information to them, the Personal Information they receive is governed by their privacy statements available via the above links. For example, if you use Bing Maps you agree to be bound by the Bing Terms of Use and Microsoft Privacy Policy.

By creating an account and logging in to the B2B Services, you are voluntarily providing your Personal Information to Ford Motor Company in the United States who then may share it in accordance with this B2B Notice, including with its affiliates in the global Ford Group (“Ford”), and Ford Motor (China) Ltd. and its affiliates in the People’s Republic of China (“China” or the “PRC”) (collectively with its affiliates “Ford China”). Vietnam

 

Ford Vietnam Limited will obtain your consent before processing (including but not limited to collecting, storing, and sharing) your Personal Information. Your Personal Information may be disclosed or transferred globally to Ford’s related companies and third-party service providers for purposes set out in this B2B Notice. Disclosures of California B2B Personnel Personal Information

 

Within the preceding twelve (12) months, we have not sold or shared for cross-context behavioral advertising the Personal Information described in this Notice. We disclose B2B Personnel Personal Information with your consent, when you direct us to share it with others, in order to conduct business with your Entity, and otherwise to operate our business. We may disclose your Personal Information for the purposes above to the following entities and individuals:
 

  • Our Affiliates and family companies. We disclose your Personal Information to our affiliates and family of companies for business and operational purposes.
  • Your Entity. We disclose your Personal Information with your Entity and Entity personnel for your Entity to sign you up to use the B2B Services, where instructed by you, when necessary to fulfill the service or provide the good you request, and for other business and operational purposes (e.g., to ensure your training and enablement credentials are current and complete). Your Entity may use such Personal Information in accordance with their own privacy policies.
  • Dealers. We may disclose Personal Information to authorized dealers where necessary, including honoring requests related to the B2B Services and providing information about B2B Personnel training, enablement, and education. Each dealership operation is a separate legal entity, independent from Ford. As such, each dealership has its own privacy practices and Ford is not responsible for these privacy practices.
  • Parties involved in training and enablement. We may disclose your Personal Information to parties involved in training and enablement programs, including faculty, administrators, coaches, and other participants, including to demonstrate training skills, show rankings, and determine progress.
  • Agents, vendors, consultants, and service providers. We disclose your Personal Information to agents, vendors, consultants, and service providers that help us provide the B2B Services to you and operate our business.
  • Law enforcement agencies, courts, regulatory agencies, and other government agencies. Right to Access/Know. You have the right to request that we provide you with the following information:
 

  • The categories and specific pieces of Personal Information we have Collected about you in the last twelve (12) months.
  • The categories of sources from which we Collect Personal Information.
  • The Business or Commercial Purposes for Collecting or Using Personal Information.
  • The categories of Personal Information we have disclosed about you for a Business Purpose and the categories of recipients to which it was disclosed.
     

Right to Delete. You have the right to request that we delete Personal Information under certain circumstances, subject to several exceptions.
 

Right to Correct. You have the right to request that we correct Personal Information that we maintain about you if you believe it is inaccurate. We may request documentation from you in connection with your request. Upon receipt of a verifiable request to correct inaccurate Personal Information, we will use commercially reasonable efforts to correct the Personal Information. You can also correct certain Personal Information that we maintain about you by logging into your Ford account.
 

Right to Non-Discrimination for the Exercise of Your Privacy Rights. You have a right to not be discriminated against for exercising rights set out in the CCPA.

 

 

How to Exercise Your California Privacy Rights

 

If you are a resident of California, you can exercise your CCPA rights by submitting your request(s) to us through our web form or by calling us at, toll-free, 1-888-392-1291, Monday through Friday from 5:00 am until 8:00 pm Pacific time or Saturday from 5:00 am until 5:00 pm Pacific time. Our call center will be closed on Sundays and on New Year’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, the day after Thanksgiving, and Christmas Day.
 

If you want to exercise more than one of your CCPA rights, please submit a separate request for each CCPA right, so we can track and respond to your requests more effectively. Please be aware that we will process your requests in the order we receive them.

Whether you use the web form or call us, we will need information from you to process your request so that we can confirm you are a California resident, determine if we have Personal Information about you, and, for access, correction, and deletion requests, verify your identity.
 

Please be aware there might be circumstances where we will not honor your request, as permitted under the CCPA. For example, if we are not able to verify your identity and that you are a California resident, we may not honor your request. In addition, we may not delete your Personal Information if an exception under the CCPA applies.
 

You may designate, in writing or through a power of attorney, an authorized agent to make requests on your behalf to exercise your rights under the CCPA. Before accepting a request from an agent, we will require the agent to provide proof you have authorized it to act on your behalf, and we may need you to verify your identity directly with us.
